The Site is operated by The Ebullient Cottage, LLC (“2225”, “we”, “us”, “our”).
By accessing or using the Site, creating an account, or purchasing products from us, you confirm that you have read, understood, and agree to be bound by these Terms of Use.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site and Content for personal, non-commercial use only, in accordance with these Terms of Use.
Except as expressly permitted by law or by us in writing, you must not:

- remove or alter any copyright, trademark, or other proprietary notices; or

Some features (such as order history, saved addresses, wishlists, etc.) may require you to create a user account (“Account”).
You must provide accurate and complete information when registering and keep your details up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.
You agree to:
- keep your password secret and secure;
- not share your Account with others; and
- notify us promptly if you suspect any unauthorized use of your Account.
We are not responsible for any loss or damage resulting from your failure to safeguard your Account credentials.
6.3 Closing Your Account
You may request closure of your Account at any time by contacting us through the Client Service section. We may retain certain information as required by law or for legitimate business purposes, as described in our Privacy Policy.

7.1 No Guarantee of Availability or Accuracy

8. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, 2225 and its officers, directors, employees, and affiliates will not be liable for:
- indirect, incidental, special, or consequential damages;
- loss of profit, revenue, business, or data; or
- any losses that were not reasonably foreseeable when you began using the Site,
arising out of or in connection with your use of (or inability to use) the Site or Content.
If we are found liable for any loss or damage arising out of or in connection with these Terms of Use, our total aggregate liability to you in respect of all claims will be limited, to the extent permitted by law, to the greater of (a) the amount you have paid to us, if any, in the 12 months preceding the event giving rise to the claim, or (b) [€100].
Nothing in these Terms of Use excludes or limits any liability that cannot be excluded or limited under applicable law (for example, liability for death or personal injury caused by our negligence, or your statutory consumer rights).
9. OUR BUSINESS POLICY
The Site and the remote sale of Products are intended primarily for consumers using the Products for personal, non-commercial purposes.
If we reasonably believe that you are purchasing for resale or business purposes, we may:
- refuse or cancel orders; and/or
- close or restrict your Account.
Business customers do not benefit from certain consumer protections that may be available under local law.
10. GOVERNING LAW AND DISPUTES
10.1 Consumers
If you use the Site as a consumer, these Terms of Use and any dispute or claim arising out of or in connection with them will be governed by the laws of the country where you habitually reside, and you may bring legal proceedings in the courts of that country, as required by applicable consumer law.

10.2 Non-Consumers / Business Users
If you use the Site in the course of a business or for commercial purposes, these Terms of Use and any dispute arising out of or in connection with them will be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles, and the state and federal courts located in Massachusetts will have exclusive jurisdiction over any such dispute.
